COLLECTORS CLUB - TERMS OF SERVICE

1. Overview of the Service

Collectors Club operates:

• •A retail storefront offering cards, sealed product, memorabilia, collectibles, and other goods ("Direct Sales").
• •A peer-to-peer online marketplace where Users may list, buy, and sell items to one another ("Marketplace").
• •Optional vaulting/storage services for Users who choose to store items with Collectors Club ("Vaulting Services").
• •Auctions, promotions, and sweepstakes, subject to the terms in this Agreement.

Collectors Club is not a broker, insurer, authentication service, or guarantor for items listed by Users.

2. Eligibility

You must be:

• •At least 18 years old
• •Able to form a binding contract
• •Not prohibited from using the Service under applicable law

By using the Service, you represent that all information provided is accurate and complete.

3. Accounts

You may be required to create an account to use certain features. You are responsible for:

• •Maintaining account security
• •Preventing unauthorized access
• •Ensuring your information remains accurate

Collectors Club may suspend or terminate any account for violations of these Terms.

4. Direct Sales by Collectors Club

When Collectors Club sells an item directly:

• •The description and photos (if provided) represent our good-faith assessment.
• •Collectors Club provides a limited authenticity guarantee for items we sell directly.
• •This guarantee is strictly limited to refund of the purchase price if the item is proven inauthentic.
• •No other remedies are available.

Important limitations

Collectors Club is not liable for:

• •Errors, mistakes, or misrepresentations made by third-party grading companies (AGS, PSA, BGS, CGC, or others).
• •Market value declines, grading outcomes, or buyer expectations regarding condition.
• •Subjective differences in evaluation of centering, edges, corners, or surface quality.

THIS GUARANTEE DOES NOT APPLY TO USER-TO-USER SALES.

5. Marketplace: User-to-User Sales

The Marketplace allows Users to buy and sell items to one another. Collectors Club does not:

• •Guarantee authenticity
• •Guarantee condition
• •Mediate disputes
• •Inspect or validate seller listings
• •Serve as the seller for User-listed items

Collectors Club is not a party to User-to-User transactions.

Buyers and sellers agree:

• •All Marketplace sales are final.
• •Items are sold "as described" by the User, not by Collectors Club.
• •Users must resolve disputes directly with one another.

Collectors Club may, at its discretion, remove listings or suspend accounts for fraud, abuse, or misrepresentation.

6. Vaulting & Storage Services

If a User chooses Vaulting Services:

• •Collectors Club will store items with commercially reasonable care.
• •Collectors Club is not an insurer or absolute custodian.

  Liability is strictly limited to the lesser of:

  •(a) the amount you paid for Vaulting Services in the preceding 12 months, or

  •(b) USD $500 per item.

You accept:

• •Collectors Club is not liable for loss, theft, fire, flooding, natural disasters, or third-party service failures except in cases of gross negligence or willful misconduct.
• •Market fluctuation is irrelevant to liability limits.

7. Fees, Payments & Taxes

Fees are disclosed at checkout or within the Service.

Users are responsible for:

• •Providing valid payment information
• •Paying applicable taxes for purchases
• •Filing any personal tax reporting obligations

Collectors Club collects and remits sales tax where required by law.

8. Shipping & Handling

For Direct Sales and Vault Redemptions:

• •Shipping costs are shown at checkout.
• •Collectors Club is not responsible for delays, carrier errors, or misdelivery caused by User input.
• •Risk of loss transfers to you when the carrier receives the package.

For Marketplace sales:

• •Shipping is the responsibility of the seller unless otherwise stated.

9. Auctions

Participation in auctions requires a verified phone number.

Auction Rules

• •All bids are final and binding.
• •Collectors Club may request proof of funds at any time.

  Failure to pay within 7 days may result in:

  •Account suspension

  •Ban from future auctions or events

  •Cancellation of the sale
• •Collectors Club may revoke any bid that violates these Terms.

10. Promotions, Giveaways & Sweepstakes

Collectors Club may run promotions, subject to:

• •No purchase necessary to enter
• •Alternate Method of Entry (AMOE) available
• •Winner selection and prize conditions specified in each promotion
• •Compliance with federal and Florida sweepstakes laws

Collectors Club may disqualify any participant for fraud, manipulation, or rule violations.

11. Prohibited Conduct

Users must not:

• •Engage in fraud, misrepresentation, or shill bidding
• •Circumvent commissions or fees
• •Sell counterfeit or altered items
• •Submit false identification or account details
• •Manipulate marketplace prices
• •Harass or threaten staff or Users
• •Bypass security measures

Collectors Club may suspend or ban accounts for violations.

12. Intellectual Property

All website content, branding, images, and trademarks belong to Collectors Club or its licensors. Users may not:

• •Copy
• •Reproduce
• •Modify
• •Distribute

…any content without written authorization.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available."

Collectors Club disclaims all warranties, including:

• •Merchantability
• •Fitness for a particular purpose
• •Non-infringement
• •Accuracy, reliability, or completeness of listings

Collectors Club does not guarantee:

• •Authenticity of User-listed items
• •Grading outcomes
• •Market values
• •Continuous platform uptime

14. Limitation of Liability

To the fullest extent allowed by law:

• •Collectors Club's maximum liability for any direct sale authenticity claim is a refund of the purchase price paid.
• •Collectors Club is not liable for:

• •Lost profits
• •Market losses
• •Emotional damages
• •Special, punitive, or consequential damages
• •Errors by third-party grading companies
• •User-to-User transactions
• •Shipping carrier issues

Where permitted, total liability is capped at USD $100 for all other matters.

15. Indemnification

You agree to indemnify and hold harmless Collectors Club from claims arising out of:

• •Your use of the Service
• •Your listings, sales, or content
• •Fraud or misrepresentation
• •Violations of these Terms

16. Dispute Resolution & Governing Law

This Agreement is governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Venue

Any dispute shall be resolved exclusively in:

• •Miami-Dade County, Florida
• •State or federal courts

You waive any right to a jury trial.

17. Modifications

Collectors Club may update these Terms from time to time. Continued use of the Service constitutes acceptance of the revised Terms.
